This week’s Win Wednesday highlights how bankruptcy can provide powerful protection when someone is facing the loss of their home.
Our client found themselves in a difficult situation after a contractor performed work on their property that they never requested and repeatedly tried to stop. Despite their objections, the contractor filed a mechanic’s lien against the property and later attempted to foreclose on their homestead.
The situation escalated to the point where a sheriff’s sale was scheduled, putting their home at risk.
Attorney Jackson Wiese stepped in and filed a bankruptcy case, which immediately stopped the pending sheriff’s sale through the protection of the automatic stay. This gave our client the breathing room they needed and prevented the loss of their home.
But stopping the sale was only the first step.
Attorney Wiese also filed an adversary proceeding seeking to remove the mechanic’s lien from the property. By taking action through the bankruptcy court, we were able to address the underlying issue that had placed our client’s home in jeopardy.
In addition to protecting their home, the bankruptcy case eliminated approximately $170,000 in debt, giving our client a fresh financial start and a path forward.
